Information on Posting of Workers in the Road Transport Sector

The posting of workers in the context of the transnational provision of services in the road transport sector is regulated by Directive (EU) 2020/1057 of the European Parliament and of the Council of 15 July 2020 laying down specific rules with respect to Directive 96/71/EC and Directive 2014/67/EU for posting drivers in the road transport sector and amending Directive 2006/22/EC as regards enforcement requirements and Regulation (EU) No 1024/2012 (“Directive (EU) 2020/1057”). This Directive defines the individual types of transport.
For some types of transport, the labour law requirements set forth in Section 319 of the Labour Code are complied with (e.g. minimum wage or length of vacation). See more in Part II. Working conditions. In the context of these transports, the driver is not considered to be a posted worker within the meaning of Directive 96/71/EC.

The European Commission has prepared opinions covering not only the control procedure and the interpretation of control competences, but above all model types of transport, together with a graphic representation and an assessment of whether or not the posting of drivers is involved.
